Cross-examination of the Fact witness - a time for strategic decision-making.

Your cross-examination needs to be tight, well-crafted, with properly timed questions, that are delivered with just the right amount of confidence and with total control. It can be done!

An overview of the basic skills and rules which the litigator needs to craft his or her cross-examination will be provided in this 4 hour course. The basic trial techniques introduced in this course are more fully covered in our 2 and 3 day Basic Advocacy programs.
Course outline
  • Review of basic theoretical notions - how to craft the questions
  • Cross-examination - yes or no?
  • Preparation for Cross-examination
  • Use of exhibits during cross-examination and use of prior inconsistent statements
  • Each participant will be designated as Attorney for the plaintiff or for the defendant. Participants will play the role of witnesses
  • Participants will work in groups in order to prepare a cross-examination of one witness. One or more members of each group will then proceed to the cross-examination of that witness and general feedback will be provided

  • Courses are available in English and French
  • Each participant will receive in PDF format by e-mail a short case summary and résumés of discovery testimony. Participants must familiarize themselves with the course materials before class.
